Section 47
Penalty Punishment

(1) If any person violates this Act or the rules made under this Act or fails to comply with the orders or instructions given by the Authority, the Authority may fine such person up to fifty thousand rupees and if any loss or damage has been caused to anyone due to such offense, compensation for such loss or damage may also be awarded. (2) If any person operates a telecommunication service without obtaining a license or complying with the conditions mentioned in the license in accordance with this Act, the Authority may fine such person up to five lakh rupees and may also order such work to be stopped.
(3) If any person misuses the telecommunication service or uses unauthorized use or damages any property related to the telecommunication service, the authority may collect fines from such person and impose fines accordingly.
(4) If any person abuses, threatens or causes unnecessary distress through telecommunication services, the authority may impose a fine of up to twenty five thousand rupees on such person and may even terminate such service. But before shutting down the telecommunication service, the authority should give the concerned person a proper opportunity to clean up.
(5) Amount of offense if any person maliciously does any work which adversely affects telecommunication line, telecommunication system or any other structure or equipment related thereto, damages or causes damage in any way or gives encouragement for such work or attempts to do such work. Such a person may be punished with a fine or imprisonment for up to five years or both, depending on the amount of damage caused.
