Section 37
Penalty Punishment

(1) A person who commits the following offenses shall be punished as follows:...
(a) In case of an offense under clauses (a) and (b) of section 36, to imprisonment for a term which may extend to five years to ten years or to a fine which may extend to one crore rupees or to both,
(b) For committing an offense under clauses (c), (d) and (e) of section 36, to imprisonment for a term which may extend to two years or to a fine which may extend to ten lakh rupees or to both.
(2) If someone commits an offense under clauses (f), (g) and (h) of section 36, the bank may fine the offender from one lakh rupees to five lakh rupees depending on the nature and seriousness of the offence.
(3) In the case of an offense punishable under sub-section (1), if there is a defect, such defect shall be recovered from the relevant offender in accordance with the prevailing law.
(4) A person who commits an offense under section 36 or who acts intoxicated in such an offense shall be sentenced to half of the punishment imposed on the principal offender.
(5) If a person fails to pay the penalty prescribed by the bank in accordance with sub-section (2) within thirty days, the bank may deduct such amount from the deposit held in his name in any bank or financial institution or freeze the immovable property in his name and send a written notice to the relevant body to arrange for the recovery of the outstanding amount. .
