Section 5
Punishment

(1) If a foreign citizen obtains a scholarship under the pretense that he is a Nepali citizen, he shall be punished with imprisonment for an additional five years or a fine of up to ten thousand rupees or both.

(2) If such foreign national receives a scholarship by certifying that he or she is a Nepali citizen, the person who proves or causes the same shall be imprisoned for an additional year and sentenced to two thousand rupees in addition to the punishment provided by other Nepalese laws.

(2A) If a person who went to study on a scholarship according to this Act does not come to contact the Ministry of Education and Sports after completing the study, all the expenses incurred while studying on such a scholarship and if any kind of grant (donation) has been given by the Government of Nepal or any organization, an amount equal to that grant shall be paid to him. There will be a fine.

(3) If anyone violates any of the conditions under section 4, he will be punished as follows:-

(a) The position specified by the Government of Nepal as per sub-section (2) of section 4 And if he does not work at the place or if he stops working, he will be fined up to ten thousand rupees,

(b) In case of physical or mental illness, or if he is unable to do so, or if he has received prior approval from the government of Nepal, to study in the middle without completing the period as per the conditions or In case of failure to take training, a fine of up to five thousand rupees will be levied,

(c) In case of violation of any other condition, a fine of up to five thousand rupees,

(4) For the purpose of sub-section (3) If someone claims that a person is incapacitated due to physical or mental illness, he/she should get it verified by the Nepal Medical Board.
