Section 32
Considered to have defected
(1) A member shall be deemed to have left the party in the following cases:-
(a) If he resigns in writing from the member of the party concerned,
(b) if he subscribes to another party, or
(c) If he himself or himself joins and forms another party.
(2) After receiving the details as per sub-section (3) of section 28, the central committee of the relevant party may expel such a member from the relevant party under this section and if any member is expelled in that way, such member will be deemed to have been expelled from the relevant party as well.
(3) Before expelling in accordance with sub-section (2), the central committee of the relevant party shall give such a member a reasonable opportunity to submit his explanation and for such purpose the relevant party may form an inquiry committee.
(4) After receiving the clarification as per sub-section (3), the central committee of the relevant party shall decide whether the clarification submitted by such member is satisfactory or not.
(5) If the explanation submitted in accordance with sub-section (3) is not satisfactory, the central committee of the relevant party may expel such member from the membership of the party after disclosing the reasons and grounds as provided in the statute.
