(1) Any national servant, by himself or by any member of his family or by anyone else, without obtaining the prior approval of the Government of Nepal or a public institution, in a way that may affect in any way any work that he is required to perform according to the position he holds. A national servant who accepts any kind of donation, donation, gift, bribe, donation or any kind of benefit or who takes bribes from a person related to the work that he has to perform according to the position he holds, will be imprisoned for three months to six months depending on the amount of the offense and his property will be confiscated.
(2) If a national servant receives a gift or a gift from someone while exchanging a gift or a gift from the funds of the Government of Nepal or a public institution, he shall immediately file such a gift or gift in his office. In case of non-filing, it will be deemed to have committed an offense under sub-section (1) and such gift or gift will be confiscated.
