Rule 8
Ability to collect and test samples

(1) The market protection officer or sub-committee may collect samples of any item for the purpose of testing from the concerned person or establishment during inspection and investigation.

(2) Sub-rule When collecting samples according to (1), the market protection officer or the sub-committee shall prepare three sample packets not less than the minimum quantity required for testing and shall seal such packets with signatures of himself and, if available, the representative of the concerned person or establishment and two other persons. .

(3) Out of the sample packets prepared by the market protection officer or the sub-committee as per sub-rule (2), one packet shall be sent to the laboratory for testing and the remaining packet shall be kept safely with him.

(4) ) If the concerned person or establishment is not satisfied with the results obtained from the test conducted by the laboratory according to sub-rule (3) and wants to have it re-tested, the market protection officer or the sub-committee shall send one of the sample packets preserved before him to the laboratory for re-testing.

(5) If there is a material difference in the results when the sample is tested according to sub-rule (3) or (4), the market protection officer or the sub-committee may send the sample of the third packet in front of him to the laboratory for testing.

(6) Sub-rule (3), (4) and (5), if the results of two tests are the same, and if the results of all the three tests are different, the results obtained from the test according to sub-rule (3) shall be valid.

(7) ) According to sub-rule (4) or (5), the related person or establishment will have to bear the expenses incurred when the sample of an item is tested in the laboratory.
