If a minor does not have a guardian as per paragraph 6 of this part, any person may act as a guardian of such a minor to protect his upbringing, health, education, care and property until he reaches the age of eighteen years.
(2) Notwithstanding anything contained in sub-section (1), a person may appoint a person as guardian for the upbringing, health, education and care of his minor.
