(1) The commission will make public the names of officials, persons or bodies who knowingly do not follow or implement the recommendations, orders or instructions made in relation to the violation of human rights as human rights violators.
(2) Before making the name public according to sub-section (1), the commission shall send a written notice to such official, person or entity to submit a vindication stating that the recommendation, order or instruction given by the commission has not been followed or implemented.
(3) If the concerned official, person or entity does not submit a written explanation according to sub-section (2) within the deadline, or if the submitted explanation is not reasonable, the name of such official, person or entity will be published by the Commission in accordance with sub-section (1).
(4) After publishing the name according to sub-section (1), the Commission shall record the name of such officer, person or entity.
(5) When recommending a person whose name has been made public in accordance with sub-section (1) for a new appointment, promotion and career development in a public position, the relevant body may also rely on the records kept as per sub-section (4).
(6) When assigning new responsibilities to the officials whose names have been made public in accordance with sub-section (1), the relevant body may also rely on the records kept in accordance with sub-section (4) in relation to his functionality.
