Section 12
Right to Inspect Inspection
(1) The Government of Nepal may inspect the hotels, lodges, restaurants and reserve bars registered in accordance with section 10 and test the food and drink used therein.
(2) According to sub-section (1), if any hotel, lodge, restaurant and resort or bar is inspected or the goods used in it are not found to be in accordance with the prescribed level, the Government of Nepal will give such hotel, lodge, restaurant and resort or bar a reasonable period of time to maintain the prescribed level. (3) If the specified level cannot be maintained even after giving a deadline according to sub-section (2), the government of Nepal may suspend the registration of such hotel, lodge, restaurant and resort or bar or assign a suitable classification of a lower level in consultation with the classification committee according to section 11.
(4) According to sub-section (3), if the hotel, lodge, restaurant and resort or bar whose registration has been suspended or in the lower level classification succeeds in maintaining the prescribed level of service, the Government of Nepal shall register such hotel, lodge, restaurant and reserve bar at the service level classification or suspend the registration. If done, the suspension can be released.
(5) Notwithstanding anything written in sub-section (4), in the case of hotels, lodges, restaurants and resorts or bars that are unable to maintain the level set in the previous year for one year from the date of suspension of registration, the Government of Nepal may cancel the registration as per section 10.
