(1) The election of members shall be held two months before the end of the term of the village assembly or city assembly. But in the case of the first election to be held after the commencement of this Act, the election will be held on the date specified in Section 4.
(2) If the term of office of head, deputy head, rural municipality chairman, vice chairman and ward chairman and municipal chief, deputy chief and ward chairman has not expired due to any reason, such vacancy shall be filled by by-election on the date fixed by the Government of Nepal in consultation with the Election Commission for the remainder of the term. But no by-election shall be held in cases where the term of office is less than one year remaining.
