Rule 46
Procedure for giving tender ballot
(1) If a voter wishes to claim that someone else has taken the ballot paper or voted on his behalf, but he is the real voter, he should attach a certificate that he has been elected as a member of the provincial assembly or the president, vice president, head or deputy head of the municipality before the polling officer. (2) In the case of making a claim according to sub-rule (1), the polling officer shall ascertain whether he is a genuine voter as claimed by the claimant. If the claimant submits a certificate that he has been elected as a member of the provincial assembly or as chairman, vice chairman, head or deputy head of a municipality, the polling officer shall take a copy of the same. (4) After making a decision according to sub-rule (3), the polling officer shall prepare the envelope of the tender ballot paper and make the signature of the claimant on the ballot paper, and write "tender ballot" in the blank space to the left of the place where the polling officer is correcting on the ballot paper and give the ballot to the voter claiming the ballot paper. (5) In the ballot given according to sub-rule (3), the claimant voter shall indicate his vote in accordance with sub-rules (1) and (2) of rule 32 and give that ballot to the polling officer. (6) Ballot box given by the claimant voter according to sub-rule (5) Tender ballots must be kept in a separate envelope and the polling officer must keep such envelope in his charge.
