Loans to the Government of Nepal and purchase of government bonds

(1) Except as otherwise provided in this Act, the Bank shall not provide any kind of financial assistance to the Government of Nepal or any entity wholly, majority or partially owned by the Government of Nepal. (3) Notwithstanding anything written in sub-section (2), the bank may provide a long-term special loan to the Government of Nepal for the payment of dues or related payments due to Nepal when it is a member of any international organization. , the loans provided to majority or partially owned organizations will be repaid in Nepali Rupees only. For the loan provided in this way, the government of Nepal will issue convertible bonds equal to the loan amount and provide it to the bank. The repayment period of such bond should cover the loan period and the prevailing interest rate. In this way, there will be a written agreement between the bank and the government of Nepal regarding all the loans provided by the bank to the government of Nepal. The total amount or limit of the loan, its terms, payment period, interest rate and other terms must be clearly mentioned in the said written agreement. Explanation: For the purpose of this section, "negotiable bond" means a bond issued as a promissory note. (5) Bank The surplus paid to the Government of Nepal shall not exceed five percent of the revenue income of the previous financial year of the Government of Nepal at any time. While calculating such revenue income, the income from debt settlement, financial grant or any other kind of financial assistance and sale of assets will not be included. (7) The total amount of bonds purchased by the bank from the Government of Nepal shall not exceed ten percent of the revenue income of the previous financial year.The issued bonds shall not be considered as loans to the Government of Nepal in accordance with sub-section (7):- (a) for purchase from the secondary market for open market operations in accordance with the Bank's monetary policy.
