Section 249
Declaration of property of foreigner who died in Nepal

(1) A foreigner who has died in Nepal has no right in Nepal, but if there is property, the person keeping the account of his death should immediately inform the nearest local level.
(2) If the notice is received according to sub-section (1), the local level shall prepare a statement of the property of the deceased with at least two local persons as witnesses and send a copy thereof to the relevant district level administrative office with a bond.
(3) According to sub-section (2), if the bond with the details of the property is received, such office shall immediately inform the Federal Ministry of Home Affairs.
(4) Upon receipt of the notice as per sub-section (3), the Federal Ministry of Home Affairs shall, through the diplomatic channel of the respective country, send a notice to the deceased's owner within four months to come to understand the property of the deceased in accordance with the law.
(5) If a citizen of a country that does not have diplomatic relations with Nepal dies and receives the information as per sub-section (3), the Federal Ministry of Home Affairs shall publish a notice in a national English language daily newspaper within six months to declare such property and the Federal Ministry of Home Affairs shall also post such notice on its website.
(6) If the rightful owner of the deceased is present within the time limit as per sub-section (4) or (5), after deducting the expenses incurred during the funeral of the deceased, he shall pay ten percent of the value of such property to the person who paid such expenses and return the rest to the rightful owner of the property.
(7) If no rightful owner of the deceased is present within the time limit as per sub-section (4) or (5) or if his address is not found, the remaining property will be given to the person who pays for the expenses of the deceased.
(8) According to this section, the property acquired by the local level shall be used only for public benefit.
