(1) During the investigation and investigation of an offense or the prosecution of a case, the entire property of a person has been withheld or taken under control in accordance with this Act, and if he and his dependents have no other means or resources for their livelihood, necessary for the humane livelihood of him and his dependents. The court may order the release of the minimum property or the provision of the property necessary for the minimum subsistence of such person from among the property that has been withheld or seized.
(2) If there is an order under sub-section (1), it should be done as follows:- (a) If the criminal case has not been filed in the court, the investigating officer should release the property or the instrument from the seized property according to the order of the court.
(b) If the seized property has been handed over to the department or district administration office by the investigating officer according to section 5, the department or the relevant district administration office, and if it has not been handed over, the investigating officer shall return the property or instrument according to the order of the court.
(c) If the seized property or instrument is auctioned in accordance with Section 21 and the amount received is deposited in a bond account or if foreign currency or exchangeable rights or precious metals or commodities are deposited in a bank, the department or the relevant district administration office shall return the property as per the order of the court. will fall
