(1) The Ministry shall determine the minimum wage of workers on the recommendation of the Minimum Wage Determination Committee under Section 107 every two years.
(2) Notwithstanding anything written in sub-section (1), if the minimum wage determination committee as per section 107 is unable to recommend a minimum wage due to the lack of consensus, the ministry shall determine the minimum wage.
(3) The minimum wage determined in accordance with this section shall be published by the Ministry in the Nepal Gazette.
(4) The minimum wages determined in accordance with this section shall be effective from the first day of the new financial year. However, if there is an agreement between the trade union and the employer regarding the date of implementation of the minimum wage, it will be according to the same.
(5) When determining the minimum wage in accordance with other existing laws, it shall not be determined in such a way that it is less than the wage determined in accordance with this Act.
