Section 31
Notification of non-holding of office

(1) If a judge retires due to age, the Judicial Council shall inform the relevant judge and body at least sixty days before his retirement.

(2) Sub-section ( 1) If a judge does not hold office due to reasons other than what is written in 1), the Judicial Council shall immediately inform such judge and the relevant body. While calculating the age, the age should be updated based on the age from which he retires first:

(a) Age from the date of birth or the year indicated in the certificate of the educational institution submitted by him,

p>(b) Age from the date or year of birth recorded in his citizenship certificate,

(c) Age from the date or year of birth written in his personal details.

(4) Subsection According to (3), when calculating the age of a judge, if the date of birth, year, month and date of birth, year, month and date are disclosed in the educational qualification or citizenship certificate and personal details, and if there is not the same date in all of them, then his age will be calculated according to the date from which he retires first.

< p>(5) If only the year or year is mentioned in the certificate of educational qualification or citizenship and personal details of a judge, the date of birth shall be established on the following basis:

(a) In case of certificate of citizenship, on the basis of the date of receipt of the certificate,

(B) Based on the date of issuance of the certificate in case of educational qualification,

(C) Based on the date of initial appointment in case of personal details.

(6) Any submitted by the judge If only the year is mentioned in the certificate and the full date of birth is disclosed in the other certificate, and if there is a gap of one year between the dates of birth mentioned in that certificate, the one with the complete date of birth will be taken as basis. If the difference between the dates of birth is more than one year, based on the certificate stating only the year, sub-section (3) date of birth shall be maintained.

(8) The Council shall determine the age of the judge in accordance with this section within three months after this section comes into effect.

(9) Subsection (1) Even if the information is not given, a judge will retire from such position after reaching the age of retirement.
