Section 2
Definition
In this Act, unless the subject or context otherwise requires,–
(a) "Medicine" means anything affecting the physical structure or process of man, animal or bird for the purpose of diagnosing, treating or preventing, curing or mitigating any disease affecting man, animal or bird or destroying an insect causing disease to man, animal or bird; It should also be considered the substance used to make or the substance applied to such substance.
(b) "Manufacturing" means the process of making, preparing, processing, converting, packing, repacking or labeling a drug or the whole or any process adopted in connection therewith. But the term shall not refer to the process of dispensing, packing or repacking the drug before its consumption or sale.
(c) "Dispensing" shall mean the act of mixing and dispensing medicine for consumption by the patient in a properly labeled container. Explanation: For the purposes of this section, "mixture" means the process of mixing two or more substances of fixed quantity in a proper manner to make a single medicine.
(d) "Label" means the name of the drug and the description written on the container containing the drug.
(e) "Physician" means a registered physician as per the Nepal Medical Council Act, 2020.
(f) "Consumption" means the act of administering or using medicine to the patient by a physician or a person authorized by the physician with the intention of improving the immediate physical and mental condition of the patient, or the act of consuming or using such medicine by the patient himself as per the prescription written by such physician.
(g) "Department" or Provincial Government shall mean the Drug Administration Department constituted as per section 5.
(h) "Manager" means the head of the department.
(i) "Inspector" means a person appointed by the department for the purpose of paragraph-6.
(j) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
