Rule 2
Definition
In these Regulations, unless the context or the context otherwise requires,–
(a) "Official representative" means a person appointed under rule 13 to participate in the accident investigation.
(b) "Commission" means the Accident Investigation Commission constituted under Rule 10.
(c) "serious injury" means an injury sustained by a person in an accident or any of the following conditions created as a result of such injury:-
(1) Hospitalization for more than forty-eight hours within seven days from the date of injury,
(2) Fracture of any bone of the body other than a simple fracture of the finger or nose (3) excessive bleeding due to injury to any part of the body or damage to nerves, muscles or nerves,
(4) Injury to any internal part of the body,
(5) More than five percent of the body has been affected by burns,
(6) Proved to have been exposed to infectious substances or lethal radiation.
(d) "Investigation" means identifying the cause of the accident, finding out the facts and drawing conclusions, exposing the human and mechanical deficiencies in the accident, recommending measures to be taken for safety and collecting and analyzing any information for the purpose of preventing future accidents. The process of including should be remembered.
(e) "State of Design" means the State in which the design organization of the type of aircraft is located.
(f) "State of Registration" means the State in which the aircraft is registered in the aircraft registration book.
(g) "Accident" in the case of a manned flight means any of the following situations occurring from the time a person enters the aircraft in preparation for the flight until he leaves the aircraft and in the case of an unmanned flight from the time the flight is prepared until the completion of such flight:-
(1) Where a person is injured or mortally injured by an aircraft or any part ejected from an aircraft or due to a jet blast or where such person dies but is injured due to natural or self-inflicted causes or attack by others;It shall not be considered that an accident has occurred in the event of death or death due to hiding or sitting in a place other than the designated place for passengers and crew members in the aircraft. Explanation:- For the purpose of this sub-section, "death" means death of the injured person within thirty days of the accident.
(2) The structural integrity of an aircraft has been adversely affected, or the structural integrity of the aircraft has been damaged so that major repairs are required, or there has been a disturbance in the structural system of the aircraft, but any damage to the aircraft's engine, cowling or accessory parts or propellers, probes, vanes, If the main rotor blade, tail rotor blade, wing tip part, antenna, tires, brakes, wheel or fairings are limited or if there are small injuries or holes in the outer sheet of the aircraft, it will not be considered as an accident according to this section.
(3) The aircraft collides with other aircraft or objects, crashes, burns or is destroyed in any other way,
(4) The aircraft is lost or completely out of reach. Explanation:- For the purposes of this sub-section, "aircraft lost" means the official search for the aircraft has been terminated or the location of the wreckage of the crashed aircraft has not been found.
(h) “State of accident” means the State in which the aircraft accident took place.
(i) "State of Manufacturer" means the State in which the aircraft manufacturing organization is located.
(j) "Chief Driver" means the main person driving the aircraft who is responsible for the flight and safety of the aircraft throughout the duration of the flight.
(k) "Authority" means the Civil Aviation Authority of Nepal established in accordance with the prevailing law.
(l) "Flight recorder" means a flight information recording device installed in an aircraft and the term includes flight data recorder and cockpit voice recorder.
(d) "Ministry" means the Ministry of Culture, Tourism and Civil Aviation (d) “Director General”;It means the director general of the authority.
(n) "Aircraft owner" means the person or organization in whose name the aircraft is registered and the term also includes the person or organization who leases an aircraft.
(s) "Aircraft operator" means a person or organization who operates an aircraft or is authorized to operate an aircraft according to the prevailing law.
(h) "Local Body" means Village Development Committee or Municipality.
(d) "State of operator" means the state where the principal business center of the aircraft operator is located and, in the absence of such center, the state where the aircraft operator resides for the purpose of operating the aircraft.
(d) "Co-Pilot" means a person who flies the aircraft as an assistant to the chief pilot.
