In this Act, unless the context or the context otherwise requires,–
(a) "Court" means the court as per section 41.
(b) "Monitor" means the monitor assigned by the Commission to monitor the implementation of the election process and code of conduct according to the prevailing federal law and the term also refers to the monitoring team or monitoring committee formed by the Commission to monitor the same.
(c) "Investigating Officer" means an investigating officer as per sub-section (1) of section 39.
(d) "Commission" means the Election Commission under Article 245 of the Constitution.
(e) "Candidate" means a person whose name is included in the final list of candidates for any election in accordance with prevailing federal law.
(f) "Election" shall mean the election of the President, Vice-President, Member of the Federal Parliament, Member of the State Assembly and Member of the local level held in accordance with the Constitution and prevailing federal laws and the term also refers to the by-election.
(g) "Electoral Officer" shall mean the Chief Electoral Officer or the Electoral Officer appointed by the Commission in accordance with the prevailing federal law and the term also refers to the Assistant Electoral Officer.
(h) "Election period" means the period from one hundred and twenty days before the date of election until the final result of the election is announced. But if the election date is announced for a period of less than one hundred and twenty days, the period from the date of such announcement until the final result of the election is announced will be considered as the election period.
(i) "Election representative" means a candidate or a representative of a political party designated by a candidate or a political party for election purposes.
(j) "Constituency" means the constituency determined by the Constituency Determination Commission under Article 286 of the Constitution for the election of members of the House of Representatives and members of the Provincial Assembly.
(k) "Voter" shall mean a person whose name is included in the final voter's list in accordance with prevailing federal law.
(l) “Votation``Ata Namavali'' means the final voter's register containing the details of the voters prepared by the commission in accordance with the prevailing federal law.
(d) "Ballot" shall mean a ballot paper arranged for voting in an election and the term also refers to a ballot paper used in such electronic equipment or a digital ballot attached to such equipment in case voting is done by electronic equipment.
(l) "Voter ID card" means the voter ID card issued to voters in accordance with the prevailing federal law.
(n) "Polling Officer" shall mean a polling officer appointed in accordance with prevailing federal law for the purpose of election and the term shall also refer to an Assistant Polling Officer.
(i) "Voting Center" means a polling station established in accordance with prevailing federal laws for the purpose of voting in elections and the term also refers to sub-polling centers.
(h) "Ballot box" shall mean the ballot box arranged by the Commission for keeping the ballot paper marked with the vote and the term also refers to the electronic device that records the vote signal of the vote cast in the case of voting by electronic means.
(D) "Political Party" shall mean a political party registered with the Commission in accordance with prevailing federal laws for election purposes.
(d) "Constitution" means the Constitution of Nepal.
