Section 2
Definition
In this Act, unless the context or the context otherwise requires,–
(a) "Work" means works presented in an original and intellectual manner in literature, art, science and other fields and the word also refers to the following works:-
(1) Books, pamphlets, articles, dissertations,
(2) Works prepared for the stage in the form of dramas, drama-musicals, silent pictures and the like,
(3) Musical composition with or without words 4) Audio visual composition,
(5) Architectural Design,
(6) Drawing, painting, sculpture, woodwork, lithography and other works relating to architecture,
(7) Photogenic composition,
(8) Works on experimental art,
(9) Citations, maps, plans, three-dimensional compositions related to geography, topography and scientific articles,
(10) Computer programs.
(b) "Author" means the person who prepares the work referred to in clause (a).
(c) "Audiovisual composition" means a filmic composition that can be viewed on a screen with or without sound.
(d) "Photogenic composition" means a composition prepared by imprinting light or other radiation on such surface with the help of chemical, electrical or any other technology in such a way that a picture appears on the surface of any object or a picture can be produced from such surface. However, a still photograph taken from an audio-visual composition shall not be considered a photographic composition but a part of the respective audiovisual composition.
(e) "sound recording" means sound recording of any performance recorded by any means or medium for listening, other than simultaneous recording of sound and image.
(f) “presentation” means—
(1) Acts of reciting, playing, dancing, acting or performing in any other way, directly or through any other device or process, in the case of other types of compositions other than audio-visual compositions,
(2) In the case of an audio-visual composition, the act of showing the adjusted scene in such a composition in sequence and also reciting the adjusted sound in it,
(3) Family or neighborhood, in the case of phonationIt should be considered the act of presenting in such a way that it can be heard in public even if there is no brother or friend or in the presence of such persons
(g) "Economic rights" means the rights granted to the copyright owner as per section 7.
(h) "Copyright holder" means the author of a work, if the economic right is vested in such author, if the economic right is originally vested in any person or organization other than the author, such person or organization, and if the ownership of the economic right is transferred to any person or organization, such Must be a person or organization.
(i) "broadcast" means the performance of a composition for public information or the transmission of an audio or audio-visual composition by means of communication or wireless equipment or by satellite.
(j) "Public communication" means the presentation, recording and broadcasting of a program, the sound or visual or both of which can be heard or observed anywhere near or far from the broadcast site, through wired or wireless equipment.
(k) "Ethical rights" shall mean the rights obtained by the author or his right holder or the person who receives the right from him in accordance with section 8.
(l) "Presenter" means an actor, singer, musician, dancer and other person who presents a literary or artistic work or folk art expression to the public through acting, singing, music and dancing.
(d) “Publication” means,–
(1) In the case of drama, film or any other kind of acting composition, the said composition has been publicly performed, sold or given for rest, whether or not translated or adapted, and
(2) In the case of any other work, it shall be considered a work which has been brought to public sale, distribution or use, with or without a translation or adaptation of that work, or a work which has been produced for sale, distribution or use, and in the case of a work which can be performed by means of acting, by adaptation or translation of that work. It also refers to things that have been performed in public without being done.
(d) “Registrar” means the DepartmentIt shall mean the person designated as per sub-section (1) of Article 30.
(n) "Royalty Collection Institution" means the institution constituted under section 39.
(t) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
