Section 2
Definition
In this Act, unless the subject or context requires otherwise,-
(a) "Dependent Family" means any surviving relative living in the same household of the Contributor:-
(1) Spouse or wife,
(2) Son, daughter-in-law or daughter,
(3) Father, mother, mother-in-law, father-in-law,
(4) grandson or granddaughter.
(b) "Executive Director" means the Executive Director of the Fund appointed as per Section 42.
(c) "Fund" means the Social Security Fund established under Section 26.
(d) "Prescribed" or "as prescribed" shall mean as prescribed or prescribed in this Act or the rules or regulations made under this Act.
(e) "Ministry" shall mean the Government of Nepal, Ministry of Labour, Employment and Social Security.
(f) "Contribution" shall refer to the amount regularly deposited or to be deposited by workers and employers in the fund to receive benefits under the social security scheme and the term also refers to the amount deposited by informal sector workers and self-employed persons to participate in the social security scheme.
(g) "Contributory income" shall mean the basic salary before deduction of tax as per the prevailing law which the worker receives from direct or indirect employment on a daily, weekly, fortnightly or monthly basis.
(h) "Contributor" means a worker listed in the social security scheme and having a social security number, a self-employed person, a person in government service or a person receiving remuneration from the government fund designated by the Government of Nepal by publishing a notice in the Nepal Gazette.
(i) "Employer" shall mean a person or establishment employing a worker and the term shall also include the following persons:-
(1) Manager at the Foundation,
(2) If a worker hires another worker, the worker employed,
(3) the labor supplier in the case of supplied labor, and
(4) In the case of a person in government service or a person receiving remuneration from government funds, the Government of Nepal, the State Government orLocal level.
(j) "Committee" shall mean the Board of Directors of the fund constituted as per section 29.
(k) "Government Service" means the Federal Civil Service, Nepal Army, Federal Police, Armed Police Force of Nepal, National Investigation Department, State Civil Service, State Police Service or related to the Government of Nepal, State Government or local level as specified by the Government of Nepal by publishing a notice in the Nepal Gazette. Other services should be mentioned.
(l) "Social Security Scheme" shall mean the social security scheme operated by the Fund in accordance with Section 10.
(d) "Benefit" shall mean the benefit or payment given on the basis of contribution to the social security scheme.
(l) "Listed employer" means an employer listed in the fund as per section 19.
(n) "Local level" means rural municipality or municipality.
(s) "Self-employed person" shall mean a self-employed person as specified by the Ministry on the recommendation of the committee by publishing a notice in the Nepal Gazette.
(h) "Worker" means a worker, employee or a person employed under any designation who performs physical or intellectual work for an employer for wages and the term also refers to workers working in the informal sector designated by the Ministry on the recommendation of the committee by publishing a notice in the Nepal Gazette.
(D) "Labor Force" shall mean Nepalese citizens who are economically active in the labor market or who are not in any kind of employment in the age group of eighteen to sixty years.
