Section 2
Definition
: In this Act, unless the subject or the context requires otherwise,-
(a) "Basic wage" means the basic wage received by the worker for employment and the term also refers to the amount of wage increase after the employment period reaches one year.
(b) "Executive Head" means the person who bears ultimate responsibility for the operation of the establishment.
(c) "Workplace" means the place or place where the worker works and the word also refers to the place or condition where the worker has to stay or go in the course of work.
(d) "Office" means Labor and Employment Office.
(e) "Lockout" means the situation where the employer closes the establishment or workplace to stop the workers from working regularly, either partially or completely. But the word does not refer to the situation where workers are kept in reserve or work is stopped due to immediate danger.
(f) "Prescribed or prescribed" means prescribed or prescribed in the rules made under this Act and the term also refers to the notice published in the Nepal Gazette as mentioned in this Act or the rules made under this Act.
(g) "Inspector" means Senior Labor Inspector, Labor Inspector, Senior Occupational Safety and Health Inspector and Occupational Safety and Health Inspector and the term also refers to other employees assigned for inspection.
(h) "Council" means the Central Labor Advisory Council constituted under section 102.
(i) "Salary" means the basic salary received by the employee and the term also refers to allowances.
(j) "Establishment" means any company, private firm, partnership firm, cooperative organization or association or any other established, established, registered or constituted or operating in accordance with prevailing laws for the purpose of providing industry, business or service for profit or non-profit. The institution should be remembered.
(k) "Ministry" means Government of Nepal, Ministry of Labour, Employment and Social Security.
(l) "Principal Employer" means an employer who employs workers through labor suppliers.
(d) "Employer" means a person or an establishment that employs workers and the term refers to the manager in the case of an establishment and also to the labor supplier in the case of workers supplied in accordance with this Act.
(l) "Employment contract" means the contract between the employer and the worker regarding the services, conditions and facilities of employment and the term also refers to the appointment letter given by the employer to the worker.
(n) "Employment period" means the period during which the worker is employed with the employer and the term also includes the following periods:
(1) Period in reserve,
(2) Period on leave with pay,
(3) Periods of leave with pay for maternity or maternity care,
(4) Period of leave during treatment due to an accident occurring while working or in the course of doing the work of the employer.
(t) "Regulations" means the regulations regarding the service conditions of the workers made by the establishment in accordance with section 108 and the term also refers to the financial administration regulations of the establishment.
(h) "Department" means the Department of Labor and Occupational Safety.
(d) "Manager" means the executive head of the establishment and the term also refers to the head of any branch or unit appointed to bear ultimate responsibility or exercise authority.
(d) "Management grade worker" means a worker who is assigned to a managerial level or higher position with the authority to evaluate, control and supervise the work of the worker on behalf of the employer, and the term also refers to the manager.
(N) "Social Security Fund" means the Social Security Fund established in accordance with prevailing laws.
(p) “collective agreement” means employmentAn agreement between the employer's organization and the trade union or collective bargaining committee regarding the workers' wages, service conditions, facilities or mutual relations between the employer and the workers.
(f) "Collective Bargaining Committee" means the collective bargaining committee as per sub-section (1) of section 116.
(b) "Labour Court" shall mean the Labor Court constituted under Section 151.
(b) "Employee" means a worker or employee who performs physical or intellectual work for an employer for wages or a person employed under any designation.
(m) "Labour supplier" means a person or an organization licensed to supply labor as per paragraph-11.
(y) "Strike" means a situation where the workers collectively refuse to do their regular work in whole or in part. However, being on leave or stopping work due to immediate danger or being unable to attend work or unable to work due to circumstances beyond the control of the workers will not be considered as a strike.
