Section 2
Definition
In this Act, unless the subject or context requires otherwise,-
(a) "Combined Housing Building" means a two or more storeyed building with two or more housing units on a plot of land and the term includes two or more similar buildings constructed on the same plot named as Block, Pocket or any other similar name. More than two buildings and those buildings also refer to land, compound, complex.
(b) "Housing unit (apartment)" means any unit of such a building having one or more rooms with communal area and facilities that can be enjoyed freely in a joint housing building.
(c) "Founder" shall mean an organized organization registered in accordance with the prevailing law and approved in accordance with section 5 to construct and operate a joint housing building.
(d) "Housing unit owner" means a person or an organized organization that purchases, rents (leases) or enjoys the housing unit in any other way subject to the conditions mentioned in the agreement under this Act.
(e) "Community area and facility" means the community area and facility mentioned in section 16.
(f) "Limited collective areas and facilities" means areas and facilities constructed or maintained for the use of certain housing units only for the wealthy.
(g) "Agreement" means an agreement made between the founder and the person taking the housing unit regarding the purchase, rental or enjoyment of the housing unit in any other way.
(h) "Committee" means the Housing Management Committee constituted under Section 24 for the maintenance, management and operation of the Joint Housing Building.
(i) "authorized officer" means the body or officer designated by the Government of Nepal by publishing a notice in the Nepal Gazette.
(j) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
