In this Act, unless the subject or the context otherwise requires,–
(a) "Purchase" shall mean the act of acquiring any goods, consulting services or other services or carrying out or causing any construction work by a public body in accordance with this Act.
(b) "Public body" means the following body:-
(1) Constitutional organs or bodies, courts, ministries, secretariats, commissions, departments or any other government bodies or offices under the Government of Nepal or provincial governments, (2) An institution, company, bank or committee wholly or mostly owned or controlled by the Government of Nepal or the Provincial Government or a commission, institute, authority, corporation, establishment, board, center established at the public level or constituted by the Government of Nepal or the Provincial Government in accordance with prevailing laws, Councils and other organized bodies of a similar nature,
(3) Universities, colleges, research centers and other academic or educational institutions of a similar nature run by the Government of Nepal or fully or mostly subsidized by the Government of Nepal,
(4) Local level,
(5) The Development Committee constituted under the Development Committee Act, 2013,
(6) Institutions run on loans or grants from the Government of Nepal, and
(7) Other institutions designated as public bodies by the Government of Nepal by publishing notices in the Nepal Gazette (c) "Goods" means any type of goods, movable or immovable, animate or inanimate, and the term shall also refer to services incidental to the supply of such goods.
(d) "Construction work" means the construction, reconstruction, demolition, maintenance or restoration of any structure or thing such as preparing the site, digging, erecting, making, installing equipment or materials, decorating, etc. It should be remembered that the word will also refer to services incidental to construction such as map making, laboratory testing, satellite photography, seismic testing.
(e) “Consultancy Services” means any study, research, survey, design, drawing, supervision, training, testing c.It means rendering work, software development or other intellectual or professional services of a similar nature.
(f) "Other services" means renting, transporting or maintaining vehicles, equipment or goods.
(g) "Tender" means a document, proposal or rate that discloses the price submitted by the bidder in the format prescribed by the public body in accordance with the notice published by the public body for procurement.
(h) "Bidder" means any person, firm, institution or company that submits or may submit a bid to participate in the procurement process.
(i) "Bidding document" means the document prepared by the concerned public body calling for bids for the bidder to fill in or prepare the price or proposal or rate and the term refers to the instructions, specifications, maps, designs, terms of reference given to the bidder. References), schedule, evaluation basis, quantity list, terms of contract and other similar documents will also be referred to.
(j) "Purchase Agreement" means the purchase agreement entered into between the public body and the supplier or construction business or consultant or service provider in accordance with Section 52.
(k) "Public Procurement Monitoring Office" means the Public Procurement Monitoring Office established under Section 64.
(l) "authorized officer" means an officer authorized to approve procurement related work in accordance with this Act or the rules made under this Act.
(d) "Security" shall mean the amount of security deposit (retention money or earnest money) held for security till the completion of any work and the term shall also refer to the amount kept for bid security or performance security or any other reason.
(d) "Special situation" means drought, lack of rain, heavy rain, earthquake, flood, landslide, natural or divine calamity like fire and epidemic or sudden or unforeseen special reason and the term includes war or internal conflict.It will also indicate the situation.
(n) "Local level" means a rural municipality, municipality or district assembly formed in accordance with the Local Autonomous Government Act, 2055.
(i) "Joint Venture" shall mean an undertaking by two or more companies or firms with joint or separate liability.
(h) "Agent" means a person, firm or company taking the agency of a domestic or foreign person, firm or company.
(d) "Official above one level" means the head of that office in the case of a regional office in the case of the head of a government agency, and in the case of a regional office, the head of the relevant department, in the case of a regional head, the head of the relevant department, in the case of a head of a department, the secretary of the relevant ministry, secretariat or commission, In the case of a secretary, the relevant departmental minister or state minister and in the case of the secretary or administrative head of a constitutional organ or agency, the head of the relevant constitutional organ or agency and in the case of another public agency, the head of an agency one level above the procuring agency, and in the absence of such an agency, the board of directors of such public agency or other similar agency. (d) "Donor Party" means any foreign country or international or foreign organization that provides foreign aid in the form of loans or grants to the Government of Nepal through bilateral or multilateral agreements.
(N) "Ration" shall mean the ration prescribed by the Government of Nepal regarding the food of Nepali Army, Nepal Police, Armed Police Force or government employees, hospital patients, prison inmates and animals etc.
(p) "Prescribed" or "as prescribed" means prescribed or prescribed in the rules made under this Act.
