In this Act, unless the subject or the context requires otherwise,-
(a) "Monitoring and Facilitation Committee" means the Monitoring and Facilitation Committee under Section 9.
(b) "Permit" means a permit or license granted to implement a project under public-private partnership as per Section 31 and for private investment as per Section 35.
(c) “Permit holder” means a firm, company or person who has been granted a permit or license to execute the project.
(d) "Consumer" shall mean a person or entity who consumes or uses services, facilities, or facilities from the infrastructure constructed by public-private partnership with private investment in accordance with this Act.
(e) "Single Point Service Center" means Single Point Service Center as per section 46.
(f) "Office" shall mean the office as per section 10.
(g) "Fund" means the fund under section 57.
(h) "Board" means the Board of Investment as per section 5.
(i) "Project" means a project related to infrastructure structure to be implemented by investing in public-private partnership according to this Act and the term also refers to a project to be implemented with private investment.
(j) "Infrastructure" means roads, tunnels, bridges, canals, reservoirs, dams, sewers, cable cars, railways, tramways, metro rail, mono rail, sky rail, trolleybus, bus rapid transit, dry port, waterway transport station; Production, transmission and distribution of renewable, thermal and geothermal energy including venues, airports, hospitals, cold storage, warehouses, public halls, stadiums, hydro-electric, organic, gas, solar, exhibition venues, amusement parks, waste treatment and management plants, communication and Infrastructure structure related to information technology, financial market infrastructure, special economic and industrial sector, agricultural sector, education sector, hotel or tourism sector and the term also refers to other infrastructure structure of similar nature.
(k) “of major works"Officer" means the Chief Executive Officer of the Board appointed as per Section 12.
(l) "Fee" means the service fee collected from the consumer for providing the service facility by the licensee.
(d) "Construction" means the development, construction or rehabilitation of infrastructure (d) "Prescribed" or "as prescribed" means prescribed or prescribed in the regulations made under this Act.
(n) "Private investment" means investment made in accordance with section 32.
(i) "Investment" means capital inflow into the project through loans or equity or reinvestment or similar financial instruments in accordance with this Act.
(h) "Investor" shall mean a firm, company or person who has invested in the project or expressed willingness to invest in the project in accordance with this Act and the term also refers to the firm, company or person who studies, develops, constructs or operates the project.
(d) "Member" shall mean a member of the Board as per section 5 and the said term shall also refer to the Chairman and Vice-Chairman of the Board.
(d) "Agreement" means the project development agreement, project investment agreement or concession agreement (concession agreement) or other similar type of agreement entered into between the government of Nepal, state government, local level or board and the investor to implement the project.
(N) "Related body" means the project implementation and facilitation board, Government of Nepal, State Government and local level or subordinate public bodies.
(p) "Survey" means preliminary study, feasibility study, environmental study, detailed feasibility study and detailed project report or other similar types of research or exploration related work for the implementation of the project.
(f) "Public Body" means the Government of Nepal, Provincial Government or local level office, organization, company wholly or mostly owned or controlled by the Government of Nepal or Provincial Government, or public as per prevailing law.Any other organized organization established at the national level or designated as a public organization by the Government of Nepal by publishing a notice in the Nepal Gazette shall mean a public organization.
(b) "Public-Private Partnership" means any of those mentioned in sub-section (2) of section 17 to build, operate, rehabilitate or provide public services in mutual cooperation between the relevant public bodies and investors by sharing resources or returns and bearing risks. The method of project implementation should be considered.
(b) "Public-Private Partnership Unit" means a Public-Private Partnership Unit as per section 14.
(m) “Local level” means rural municipality or municipality.
