Section 2
Definition

(1) In this Act, unless the subject or context requires otherwise,–
(a) "Birta Jagga" shall mean all types of land acquired or entitled to by paying the government property free of charge or by paying less than the property of the same type of raker land and also the land as defined in clauses (b) and (c) means .
(b) "A" category birta land means the birta land that is acquired to be taken for consumption up to the agreed amount or the way it was acquired regardless of the agreed amount of bilta or the birta land that has to be taken and eaten up to the number of the bilta to be paid or not to the Government of Nepal and unclaimed land and forest birta land It should also be remembered.
(c) “B” category land shall mean all other land except “A” category land.
(d) "Birtawal" means the person in whose name the birta land is registered or in whose name there is a deed of grant of birta land or who has enjoyed the birta land or the person entitled to enjoy the birta land of such person and by taking the birta land by usufructuary or by any other means. If enjoyed, it also refers to him or his rightful owner who enjoys such land until such enjoyment.
(e) "Property" in relation to Rakar land means the property registered in respect of Birta land (hereafter referred to as Mohi of Rakar in this Act) as agreed to be delivered to the Government of Nepal in cash or in kind or both, and this word also means the same agreement to be taken by Birtawal in relation to Birta land. It also refers to the property (like Rakar Jagga of Antha) and the amount taken by the Birtawal according to the rights obtained by taking the approval of the Mohi of the Birta Jagga or not, and adding it in terms of hundred kadi on such property.
(f) "Mal Adda" means the goods depot of the Government of Nepal which is taken over by customs clearance and also refers to the land administration office at the place where the goods depot is cancelled.
(g) "Aysta" in relation to the land plot means the cash or goods that have been given to someone to earn money, whether written or not.

(3) In order to avoid any doubt while making a decision under sub-section (2), it shall be clarified that a person has given to someone to earn from one chakala or one piece of land by taking only the property of some and taking the aysta of some of the land, whether in writing or not, or some part of such land. If the land is self-earned, even if it is one chakala or one share, it will be considered as "A" category birta land and as much as "B" category birta land is given by eating or earned by oneself.
