Rule 12
Extent, manner or term of the amount to be deducted from the salary
: (1) According to section 24 of the Act, when the salary of a worker or employee is to be deducted, it can be deducted subject to the following:
(a) In case of deduction of the fine, it shall not be increased at the rate of thirty-three percent of the salary to be received each time, unless such fine or the amount to be deducted is overdue.
(b) Deduction due to knowingly or negligently causing monetary or material damage to the tea plantation or loss of any item shall not be increased at the rate of twenty five percent of the remuneration received each time unless the amount to be deducted is beyond the collection.
(c) In case of deduction of advance or excess wages or benefits, if any condition has been determined between the manager of the tea plantation and the workers or employees regarding the deduction, such advance or excess shall not be increased at the rate of twenty-five percent of the wages received each time in accordance with the same condition and if such condition is not determined. Unless the amount of wages is overdue.
(d) In case of deduction according to the order of any government office or court, if there is a time limit set in such order, at the rate of the percentage required to be paid within the same time limit, and if the time limit is not set, at the rate of fifty percent of the remuneration received each time, without increasing the amount according to such order, until the amount is overdue. br> (e) In other cases prescribed by the Government of Nepal by publishing a notification in the Nepal Gazette, if any amount is to be deducted, the amount to be deducted shall not be increased at the rate of fifty percent of the remuneration received each time, unless the amount to be deducted is overdue. (2) Notwithstanding anything written in sub-rule (1), if all the amount to be recovered from the worker or employee of the tea estate has not been deducted, if he dies or retires from the service of the tea estate due to any reason, the amount remaining to be recovered from him shall be from the same amount, if any, from the tea estate. Deductions will be made on the invoice.
