Section 50
Method of review

(1) A bidder or a consultant who submits an application to the review committee for review under section 48 shall submit an application to the review committee within seven days in the case of clause (a) of section 49 and within thirty days from the date of such agreement in the case of section (b).
(2) Within three days of receipt of the application in accordance with sub-section (1), the review committee shall inform the relevant public body of such application and, if any document is attached to the application, send a copy of the document and give information and feedback on the action taken in that regard.
(3) Within three days of receiving the notice as per sub-section (2), the public body shall give the related information and response to the review committee.
(4) Based on the information and feedback received according to sub-section (3), the evidence and documents submitted by the applicant with the application and if necessary, the review committee shall make a decision within thirty days of receiving the application according to sub-section (1).
(5) While making a decision according to sub-section (4), the review committee may make the following decision:-
(a) Dismissal of application,
(b) In case the purchase agreement has not been concluded,—
(1) Ordering the public body not to take any unauthorized action or decision or wrong procedure,
(2) To order the cancellation of the unauthorized action or decision made by the public body in whole or in part,
(3) If there is any error in the evaluation of bids or proposals and it is necessary to re-evaluate, to order to re-evaluate and mention such error.
(c) In the event that the purchase agreement has been concluded, if the review committee feels that such an agreement should be received by the applicant, it will recommend to the public body to pay the amount of reasonable compensation to the applicant after considering the harm caused to the applicant.
(6) The petitioner who submits an application for review in accordance with this section shall keep the prescribed security.
(7) In case the application is dismissed as per clause (a) of sub-section (5), the amount of such security shall be confiscated.
