Rule 19
Procedures of the Appeals Committee -
1) All the members of the Appeals Committee will collectively take action on the appeals submitted to the Appeals Committee and establish a bench.
(2) Notwithstanding anything written in sub-rule (1), the action on the appeal can be done by any two members and the final action of the appeal can be done if one of the members including the chairman is present.
(3) If there is a unanimous vote of all three members or a majority of two members in a bench where three members are present, that vote shall be considered as the decision of the appeals committee.
(4) If unanimity cannot be reached in a bench with two members present, in case of action, it shall be done according to the opinion of the chairman if it is a bench with a chairman and if it is a bench without a chairman, it shall be done according to the opinion of the law member. In the case of appeal decision or final order, the opinion submitted to the absent member and supported by him will be the decision of the appeal committee.
(5) According to sub-rule (4), if the majority cannot be maintained even when presented to the member who is absent first, it will be submitted to the Supreme Court for decision and the decision of the Supreme Court will be final.
(6) The Appeals Committee shall normally decide the appeal within three months.
(7) Other procedures of the appeal committee shall be as determined by the said committee itself.
