Rule 69
Can establish a rehabilitation center
(1) If any organization wants to establish a rehabilitation center, it should submit an application to the Council in the format as per schedule-1, attaching the documents mentioned in the schedule.
(2) According to sub-rule (1), the organization that wants to establish a rehabilitation center must have fulfilled the following qualification: 5
(a) registered as a non-profit social organization according to the prevailing law,
(b) having the objective of operating a rehabilitation center in the statute of the organization, (c) having child-friendly physical infrastructure and structures capable of providing services to at least twenty children as specified by the council,
(d) Ensuring financial resources for at least three years for the operation of the rehabilitation center,
(e) having manpower as specified by the council to serve in the rehabilitation center,
(f) Having child protection standards as per Section 57 of the Act.
(3) According to sub-rule (2), the director of an organization who wants to establish a rehabilitation center must have completed the qualifications mentioned in clause (d) of sub-rule (2) of rule 59.
(4) In accordance with sub-rule (1), the council will recommend to the Ministry for the approval of the Government of Nepal as per sub-section (2) of section 71 of the Act, if it is found suitable after examining the documents and details attached to the application.
(5) If the recommendation as per sub-rule (4) is deemed appropriate, the ministry will submit a proposal for approval to establish a rehabilitation center to the Government of Nepal.
(6) Based on the proposal submitted as per sub-rule (5), if the Government of Nepal approves, the council will issue a certificate of permission to establish and operate the rehabilitation center in accordance with schedule-6.
(7) Organizations that have been granted permission to establish and operate a rehabilitation center shall renew it within three months of the end of each financial year.
(8) An organization that has been granted permission to establish and operate a rehabilitation center shall submit an application to the Council for renewal in the format as per Schedule-7, attaching the documents mentioned in the same schedule.
(9) According to sub-rule (8). After examining the application received, the council will renew the operating permit.
