Section 16
Permission to be obtained for archaeological excavations:

(1) A person or organization wishing to carry out archaeological excavations in a place where there is an ancient monument shall obtain the prior approval of the Government of Nepal as prescribed. 1) If an object or monument of archaeological importance is found during the excavation with permission, the notification shall be given to the Department of Archeology or the Chief District Officer within forty-eight hours and the Chief District Officer shall immediately inform the Department of Archeology.

(3) According to sub-section (2), the archaeological property obtained during excavation shall belong to the Government of Nepal.

(4) A person who carries out excavation work without taking approval as per sub-section (1) shall be fined up to twenty five thousand rupees or imprisoned for up to five years or both.

(5) According to sub-section (2) a person who carries out excavation work without giving notice to the Department of Archeology or the Chief District Officer shall be punished with a fine up to fifteen thousand rupees or imprisonment for a term up to three years or both.
