(1) In accordance with section 76 of the Act, the person requesting a preliminary injunction shall submit an application to the department in the format prescribed by the department.
(2) The department shall give a decision on the matter within forty-five days after receiving the application as per sub-rule (1).
(3) If no pre-order is received from the department within the period as per sub-rule (2), the petitioner may file an application for administrative review before the department in accordance with section 115 of the Act or file an appeal with the revenue tribunal in accordance with sub-section (4) of section 116.
(4) Before making a decision according to sub-rule (2), the department may, if deemed necessary, conduct an examination by the officer and other experts.
