Section 6
Non-Registration of Patent
: (1) The Department shall not register a patent under this Act in the following cases:-
(a) has already been registered in someone else's name, or
(b) the patent sought to be registered by the applicant has not been invented by him and he has not acquired rights from the inventor, or
(c) the patent sought to be registered would have any adverse effect on the health, morals or morals of the general public or on the national interest, or
(d) If there is a violation of any prevailing Nepal law. But nothing written in Clause (a) shall not be considered as an obstacle to rejecting the filing of patent registration in accordance with Section 9.
(2) In the case written in sub-section (1), the department may cancel the registration of any patent that has already been registered. But according to that, before canceling the registration of a patent, the patent holder should be given an opportunity to show that there is any reason why the registration of the patent should not be canceled.
(a) has already been registered in someone else's name, or
(b) the patent sought to be registered by the applicant has not been invented by him and he has not acquired rights from the inventor, or
(c) the patent sought to be registered would have any adverse effect on the health, morals or morals of the general public or on the national interest, or

(2) In the case written in sub-section (1), the department may cancel the registration of any patent that has already been registered. But according to that, before canceling the registration of a patent, the patent holder should be given an opportunity to show that there is any reason why the registration of the patent should not be canceled.
