Section 112
The establishment can evaluate the performance of workers

(1) The establishment can generally conduct performance evaluation of workers once a year.
(2) The basis and procedure for performance evaluation as per sub-section (1) should be determined in a fair and reasonable manner.
(3) The basis and procedure according to sub-section (2) should be informed to the workers before the period of work execution begins.
(4) After evaluating the work performance according to sub-section (1), the employer or the person designated by him shall discuss with the concerned worker about his strengths and weaknesses and give him a reasonable opportunity to improve the weaknesses.
(5) If the concerned worker disagrees with the evaluation made according to sub-section (4), he/she should be given an opportunity to mention the disagreement and have to sign the performance evaluation form.
(6) If the worker disagrees according to sub-section (5), the establishment shall make arrangements for review in that regard.
(7) Other arrangements related to performance evaluation of workers shall be as prescribed.
