Section 161
Evidence to be submitted

(1) The plaint and the copy of the written evidence related to the claim mentioned in the plaint and the defendant mentioned in the reply must be submitted together with the plaint or reply.
(2) Notwithstanding anything written in sub-section (1), if the Government of Nepal is not able to submit written evidence immediately with the plaint or counter-affidavit in a case where the Government of Nepal is the plaintiff or the defendant, the details of the office where such evidence is or may be kept may be disclosed in the plaint or counter-affidavit.
(3) According to sub-section (2), if the details related to the evidence are mentioned in the plaint or the counter-answer, the court may extract such evidence from the relevant office as per the requirement.
(4) Notwithstanding anything else written in this section, if the original copy of any written evidence cannot be submitted to the court immediately, a formal copy may be submitted along with the reasons for the same.
