Rule 14
Evaluation and selection of proposals

(1) The Authority shall form an expert committee within three days after the end of the proposal submission period to evaluate the proposal received in accordance with Rule 12 and make a recommendation to the Authority for choosing the appropriate proposal.
(2) While evaluating the proposal, the expert committee as per sub-rule (1) should first open only the technical proposal and evaluate it on the following basis and select the technical proposal of the proposers who get at least 60 percent marks:-
(a) Financial status of the proposer,
(b) Proposer's technical ability and experience and manpower efficiency and experience,
(c) Organizational arrangement and implementation schedule related to project implementation,
(d) Engineering design of the project,
(e) Financial resource arrangements for implementing the project and related plans,
(f) Other grounds determined by the authority prior to calling for proposals.
(3) After selecting the technical proposal according to sub-rule (2), the expert committee shall notify the selected technical proposal proposer stating the date, time and place of financial proposal opening.
(4) According to sub-rule (2), the authority shall give a notice to the proposers of technical proposals who have not been selected to withdraw their financial proposals. If the financial proposal is withdrawn within three days from the date of such notification, the authority shall return the proposal to the relevant proposer.
(5) The expert committee will open the financial proposal in the presence of the relevant proposer or his representative on the date, time and place as per sub-rule (3). But the opening of the financial proposal will not be stopped just because the concerned proposer or his representative is not present.
(6) When opening a financial proposal in accordance with sub-rule (4), a bond shall be raised so that it is clear whether such proposal has been duly filed or not, and the signature of the present proposer or his representative shall be made.
(7) The expert committee as per sub-rule (1) will evaluate the financial proposal on the following basis:-
(a) Project carEnvironmental sustainability,
(b) Business Plan for Project Implementation,
(c) causing minimal damage to the environment,
(d) Rental rates charged from industries established and operating in special economic zones (E) Facilities and modern infrastructure to be provided to industries established and operated in special economic zones (f) the rate of service charge proposed to be provided to the Authority,
(G) Other grounds determined by the authority before issuing the notice of call for proposals.
(8) In accordance with sub-rule (7), after evaluating the financial proposal, the financial proposal of the proposers who get at least 60 percent marks should be selected.
(9) According to sub-rule (2) the score obtained in the technical proposal and the score obtained in the financial proposal as per sub-rule (8) for the proposal selection of the proposal of the proposer with the highest score within thirty days from the date of commencement of work by the expert committee as per sub-rule (1) report with recommendations to the authority should be submitted. While recommending in such a way, other proposals that are suitable should also be recommended as alternative proposals in order of priority.
(10) After receiving the report with the recommendation of the expert committee according to sub-rule (9), the authority shall study such report and recommend to the Ministry for approval along with its opinion regarding the proposed proponent for selection. Before recommending in this way, the authority can hold necessary talks with the proposer who has been recommended for selection.
(11) Based on the recommendation made by the authority according to sub-rule (10), if it is deemed necessary to implement the project with the participation of the Government of Nepal, the Ministry will submit a proposal for the approval of the Government of Nepal including the conditions of the investment agreement.
(12) According to sub-rule (11), prior to preparing the terms of the contract, the Ministry will negotiate with the proponents who have been recommended for selection on matters related to project implementation.
