Rule 16
Not being a viable candidate for promotion
(1) Notwithstanding anything contained elsewhere in these Regulations, no soldier shall be a potential candidate for promotion in the following circumstances:-
(a) for suspension for the entire period of suspension, (b) for withholding of promotion for the entire period of suspension,
(c) For reduction to a lower post, from the date of the same, up to one year,
(d) in the Annual Performance Appraisal Form (in the pen drawing of Nekibadi) written as ineligible for promotion and such opinion is supported by the authorized military inspector- up to that financial year,
(e) during the period on leave for study or training in private endeavor,
(f) during the period pending before a Court of Inquiry in respect of any offence,
(g) in the case of an offense under investigation until such investigation is concluded,
(h) unless cleared by the court of any suit filed in court in respect of any offence,
(i) For being punished by the court for any offense until the punishment is paid.
(2) Officers, rank and badge officers cannot be potential candidates for promotion in the following cases:-
(a) If convicted of offenses such as financial irregularities and polygamy,
(b) If it is determined by the court that an act of violation of human rights or humanitarian law has been committed, (c) If the health classification MEDDI CCOS-G is more than two.
(3) Notwithstanding anything contained in clause (c) of sub-rule (2), in the case of a soldier in training or in the performance of his official duties: In case of any bodily injury and during the examination of his health, he shall be physically and mentally healthy except for the part injured. If the medical board grants him the health classification MEDDICISOS G two, he can be a potential candidate for such military promotion, as he is capable of performing the duties and related training.
