(1) The following industries or persons desirous of availing the facility of bonded warehouse shall apply to the department for a licence:-
(a) Industries exporting ready-made garments to foreign countries,
(b) Industries exporting their products to third countries,
(c) industries other than the industries mentioned in clause (a) which export to India at least twenty-percent of their production or goods worth more than one crore rupees,
(d) A person importing goods for sale from a duty-free shop approved by the Government of Nepal.
(2) The industry making the application according to sub-rule (1) shall also submit proof that it is an industry as per clause (a), (b) or (c) of the said sub-rule. However, if an industry that has not completed one year of operation wants to get a bonded warehouse license, it is not required to submit the proof if it submits an export plan and a confession to export its products to foreign countries or to export at least twenty percent of the products or goods worth more than one crore rupees to India.
(3) On the basis of the necessary investigation on the application received as per sub-rule (1), if it is found desirable to grant the license of the bonded warehouse, the department may grant the license to the applicant by taking six thousand rupees as the license fee.
(4) The term of the license as per sub-rule (1) shall be maintained for one financial year. A licensee who wants to renew such a license has to renew such license from the Tiri Department for each financial year before the start of that financial year by paying three thousand rupees as a renewal fee.
(5) The licensee who does not renew the license within the period as per sub-rule (4) may renew the license by paying an additional fee of three thousand rupees within six months after the end of the financial year. The license which is not renewed even within such period will be canceled automatically.
(6) Notwithstanding anything written in sub-rule (5), the licensee of the bonded warehouse shall not be entitled to enjoy the facilities of the bonded warehouse during the period in which the license is not renewed.
