Rule 10
Facility to be obtained by the Licensee of Bonded Warehouse

(1) According to rule 9, the licensee of the bonded warehouse may import raw materials or auxiliary raw materials (including packing materials not produced in Nepal) required to produce the goods to be exported or sold in the country in exchangeable foreign currency by giving a bank guarantee.
(2) According to sub-rule (1), when giving a bank guarantee, a bank guarantee must be given equal to the customs duty on the goods to be imported, an additional amount of fifteen percent of the same and the amount to be calculated after calculation of ………..
(3) The period of bank guarantee given according to sub-rule (1) should be from six months to one year. If the bank guarantee of six months has to be extended later, it can be extended up to a maximum of six months. But if the deadline is extended according to rule 13, the deadline of the bank guarantee should also be extended accordingly.
(4) In the case of packing material which is not produced in Nepal, facilities will be given only in cases where the Department of Industry certifies that it is not produced in Nepal and recommends the facility of bonded warehouse.
(5) A person who has obtained the license of a Wounded Warehouse House and is approved to operate a duty-free shop shall be allowed to import the goods for sale from such duty-free shop by keeping a bank guarantee of an amount equal to the duty levied on the imported goods. While importing the goods in this way, the approval of such goods and quantity should be taken from the department.
(5a) Among the goods imported according to sub-rule (5), alcohol and cigarettes will be allowed to be sold only to persons or entities designated by the department to provide diplomatic and customs facilities based on the recommendations made by the Government of Nepal, the Ministry of Foreign Affairs as per sub-rule (2) of rule 3.
(6) According to the agreement made by the licensed industry of the bonded warehouse with the foreign buyer who will purchase its products, the buyer located abroad without a certificate of purchase under the recommendation of the Department of Commerce imported the raw materials and auxiliary raw materials sent without price and made ready-made goods from them and started the production process.In case of exporting to the same buyer or to other persons as per the recommendation of the Commerce Department by taking only the cost and profit payment, the customs duty levied on importation of such raw material and auxiliary raw material and ………. It will be allowed to import after giving a bank guarantee equal to the amount of the deposit.
(7) When importing goods in accordance with sub-rule (6), the importer shall fulfill the conditions and procedures prescribed by the Department of Commerce in the case of importation, the recommendation letter issued by the said department in the name of the customs office, the agreement made with the foreign buyer and the invoice including the invoice with no value but the price disclosed for customs purposes. (8) When giving a bank guarantee according to this rule, a bank guarantee issued by a bank or a financial institution authorized to issue a bank guarantee according to the prevailing law shall be given.
