Rule 62
Establishment and Operation of Children's Home

(1) For the purpose of protecting children in need of special protection, the Government of Nepal, the Provincial Government or the local level may establish children's homes as needed.
(2) Anyone can operate a children's home in accordance with the existing law: after registering the organization and obtaining permission from the council.
(3) Schedule-1 for permission to operate children's home according to sub-rule (2). An application should be submitted to the council in the following format, attaching the documents mentioned in the schedule.
(4) In accordance with sub-rule /(2), the institution that wants to obtain permission to operate a children's home must have fulfilled the following qualifications:-
(a) registered as a non-profit social organization according to the prevailing law,
(b) having the purpose of operating a children's home in the statute of the institution,
(c) having child-friendly physical infrastructure and structure as specified by the council that can provide protection and services to at least twenty children, (d) ensuring financial resources as specified by the council and having the necessary human resources,
(e) having child protection standards as per section 57 of the Act:
(5) According to sub-rule (2), the director of an organization who wants to operate a children's home must have completed the qualifications mentioned in clause (d) of sub-rule (2) of rule 59.
(6) Children's home during examination and on-site study of the application received according to sub-rule (3). The council may grant permission if it deems it appropriate to grant permission for operation.
(7) The council shall make available the license for the operation of the children's home in the format as per Schedule-2 to the organization which has received permission according to sub-rule (6).
(8) Child (home) - The organization licensed to operate shall renew within three months of the end of each financial year.
(9) An organization that has received permission to operate a children's home should submit an application for renewal in the format as per schedule-3 and attach the documents mentioned in the schedule.
(10) According to sub-rule (9), the council will renew the operating permit certificate after examining the application. (11) Children's homes operated by any organization before the commencement of this regulation shall obtain permission from the council within one year from the date of commencement of this regulation.
