Rule 38
Action against workers or employees who are absent without taking leave
: (1) No worker or employee should be absent from the tea garden without taking leave.
(2) If a worker or employee is absent from the tea garden for more than thirty consecutive days without giving notice of leave or without accepting the leave, such worker or employee may be dismissed from the service of the tea garden.
(3) Notwithstanding anything written in sub-rules (1) and (2), if the leave is granted for such period after the unforeseeable reason for which the leave cannot be granted, it shall not be considered as a violation of this rule.
(2) If a worker or employee is absent from the tea garden for more than thirty consecutive days without giving notice of leave or without accepting the leave, such worker or employee may be dismissed from the service of the tea garden.
