Section 51
Consequences of trafficking
(1) In relation to the profit obtained from the sale, the payment shall be made according to the following order of priority:- (a) Manasib Mafiq paid by the mortgagee to the legal practitioner and the legal expenses incurred during the settlement of the case, including the recovery of the mortgaged property, acceptance, preparation for sale and Manasib Mafiq expenses incurred during the sale. , (b) Loans secured by mortgage rights, (c) Loans secured by the rights of subordinated mortgages over the mortgaged property, if a written request is received and the person taking the subordinated mortgage right gives reasonable evidence of such right before the distribution of the profit obtained from the sale. (2) The mortgagee from the sale of the mortgaged property. The amount received and saved shall be returned to the mortgagor and unless otherwise agreed upon, the mortgagor shall be responsible for the insufficient amount. The receiver who receives the price in good faith at the sale shall acquire the mortgaged property without all rights, mortgage rights or subordinate mortgagee rights or privileges in such mortgaged property, and (b) the office keeping records of the ownership of the mortgaged property shall issue a new proof of ownership to the buyer of the mortgaged property. If requested by that office, the authority to issue a new proof of ownership in the form of the order given by the court so that the mortgagee can take possession, or if the obligation is not complied with, the written agreement made by the mortgagor to transfer the possession to the mortgagee shall be submitted to that office.
