Section 13
Documents related to bidding must be prepared
(1) The public body must prepare documents related to bidding before inviting bids.
(2) The following things should be mentioned in the documents related to the bid as per sub-section (1):-
(a) Nature of procurement, time period for procurement and technical specification thereof,
(b) If the tender is invited without prior determination of qualification, the grounds of qualification of the bidder as per clause 10,
(c) If there is a provision for on-site inspection, information about it (d) If any meeting is to be held prior to submission of bids, information regarding such meeting,
(e) instructions for preparation and submission of tenders, place of submission of tenders, last date and time for submission of tenders and date, time and place of opening of tenders,
(f) the price structure (component of price), the currency or currencies that may be quoted for bids, the currency used to compare bids and the basis of the relevant exchange rate and the date thereof,
(g) Basis and manner of evaluation of bids and selection of bidders,
(h) If preference is given to indigenous goods and local builders, the provisions regarding the same,
(i) If the goods or construction works are to be procured in separate groups and packages, such groups and packages and the manner of evaluating the same,
(j) Method of evaluation of such alternative in case proposal of alternative technical specification is requested,
(k) Details of such part or parts, if bids can be submitted only for any part of the goods, construction work or service to be purchased,
(l) Bid validity period,
(d) the amount, type, valid form and valid period (validity period) of security to be given for bid, performance or other necessary matter,
(d) In case of bid security, the period of the security should be thirty days longer than the period of acceptance of the bid,
(1) In case of accepting a score less than fifteen percent of the cost estimate of the bidder, five percent of the accepted score and more than fifteen percent of the cost estimate shall be reduced.In the case of acceptance, if the amount is more than fifteen percent, the amount that will be fifty percent is added to five percent of the acceptance number and the performance bond should be kept.
(52) Financial and technical details submitted by the bidder at the time of tendering or contracting with any public body,
(3) If the bidder initiates any work in agreement with any public body, such body, description of work, amount of contract and details of work progress,
(4) In the case of commencement of work in accordance with clause (3), the technical capacity of the bidder in use in a public body as mentioned in the document mentioned in clause (b) of sub-section (3) of section 7, to the extent required by such body, the technical capacity of such bidder for additional work. (n) Terms and conditions of the purchase agreement as per section 52 and the manner in which the agreement will be enforced,
(i) Information regarding legal action to be taken in case of conflict of interest or not to take action on the tender or fraud or corruption,
(h) The provision that the bidder can file an application for review against the error or decision made by the public body while taking action related to the bid,
(d) Documents proving technical capability and financial proposal (bid) should be submitted in a single envelope, and
(D) Matters determined by the Public Procurement Monitoring Office to be mentioned in the pre-qualification or bidding documents.
(3) To the person, firm, institution or company who requests documents related to the bid according to the notice of invitation of bids, and if pre-qualification is required to participate in the procurement process, to the person, firm, institution or company who has obtained pre-qualification and requests such documents, by taking the fee prescribed by the public body Documents related to the bid should be provided.
