Section 27
Acceptance of Bids and Purchase Agreement

(1) According to Section 25, the public body shall select for approval only the minimum evaluated substantially effective bids.
(2) According to sub-section (1), within seven days after the selection of the bid, the public body shall notify the concerned bidder of the intention to accept his bid. The name, address and amount of the bidder of the selected bid should also be given to other bidders.
(3) If any bidder does not make an application in accordance with section 47 within the period of seven days after giving the notice as per sub-section (2), the bid of the selected bidder as per sub-section (1) shall be accepted and he shall be notified within fifteen days to file performance bond for entering into the purchase contract.
(4) Within the period of sub-section (3), the relevant bidder shall submit a performance bond and enter into a purchase agreement as per section 52. In this way, if the bidder accepts a score less than fifteen percent of the cost estimate while submitting the security, five percent of the acceptance score and more than fifteen percent of the cost estimate is accepted, and if the bidder accepts a reduction of more than fifteen percent, fifty percent of the amount will be added to five percent of the acceptance score. (5) If the bidder fails to enter into the contract after submitting the performance bond within the period of sub-section (3), the bond amount of his bid shall be confiscated and immediately after that, the bid of the lowest evaluated bidder shall be accepted and the purchase contract shall be concluded.
(6) If the bidder as per sub-section (5) fails to enter into the purchase agreement after submitting the performance bond, then the bids of the bidders with the lowest evaluated value shall be gradually accepted and the notification shall be given to him to enter into the purchase agreement in accordance with this section.
(6a) The public body should generally complete the work related to the acceptance of the bid and the purchase agreement within the validity period of the bid as per section 20.
(7) If a bidder whose bid has been rejected within thirty days of the notification under sub-section (2) requests information on the reason why his bid has been rejected, the relevant public body shall provide such information to him.
