Rule 37
Provisions relating to Licensing of Customs Agents
(1) The department may from time to time publish a public notice and call for applications from those who are interested in obtaining a license as a customs agent.
(2) After the publication of the notification according to sub-rule (1), the person who wants to obtain the license of the customs agent who meets the following qualifications may submit an application to the department or the customs office in the format as per Schedule-5, attaching the documents prescribed by the department:-
(a) Nepalese citizens who have reached the age of 21 years,
(b) Graduated from a recognized educational institution or equivalent and has completed at least three months of basic computer training,
(c) There is no outstanding amount to be paid to the Government of Nepal (d) Not found guilty by the court of any criminal charge.
(3) Notwithstanding anything written in sub-rule (2), a person who has been appointed as a representative of a customs agent till 14th Baisakh of the year 2065 and has been working as a representative of a customs agent for the past two years, if the head of the relevant customs office verifies that practice based on the records of the office, such person shall be appointed as a representative of the customs agent. The qualification of clause (b) of sub-rule (2) shall not be required to apply for a licence.
(4) The department will select the suitable persons to issue the license of customs agent from among the applicants through written examination and interview.
(5) In the case of the person selected as per sub-rule (4), seven thousand rupees for the customs agent's license fee and seven lakh rupees for the bond in cash or bank guarantee equivalent to that amount, the department and in the case of the customs office in the case of the application in the customs office, the relevant customs office Schedule-6 Customs agent license should be given in the following format.
(6) The duration of the license of the customs agent granted as per sub-rule (5) shall be maintained for one financial year. The licensee desiring to renew such license shall pay a renewal fee of Rs.An application must be submitted to the licensing authority to:-
(a) Tax payment certificate,
(b) If the customs agent's license is obtained with a bank guarantee, the bank guarantee is valid for the period for which such license is to be renewed, but if the licensee who wants to renew the customs agent's license wants to renew it at once for the sake of three financial years, he can renew it by paying the renewal fee for three financial years in one lump sum. br> (7) A licensee who is unable to renew the license of a customs agent within the period as per sub-rule (6) may renew the license by paying an additional fee of seven thousand rupees within one year from the date of expiry. The license of the customs agent who does not renew even within that additional period will be automatically cancelled.
(8) Notwithstanding anything written in sub-rule (7), no work shall be done as a customs agent during the period of non-renewal of the customs agent's license.
(9) The licensee of the customs agent shall personally attend the customs office and work.

(14) The department may create and implement necessary procedures regarding the level of customs agents, code of conduct, examination procedures, curriculum and other matters related to customs agents without being contrary to the Act and this regulation.
(15) Customs agent's license issued before 14th Baisakh of the year 2064 shall be deemed to have been issued in accordance with this regulation.
(16) Notwithstanding anything written elsewhere in this rule, a person who has been appointed as a representative of a customs agent for the past two years up to 14th of May 2064 and has been working as a representative of a customs agent, if the head of the relevant customs office verifies such behavior based on the records of the office, sub-rule (10) The qualification of clause (b) of sub-rule (2) shall not be required to appoint a representative as per ……..
