(1) Employers shall not discriminate against workers on the basis of religion, race, gender, caste, origin, language or ideological belief or any other similar basis.
(2) Notwithstanding anything contained in sub-section (1), the following shall not be deemed to constitute discrimination:-
(a) giving preference in employment to any person on the basis of the inherent need of the work or service,
(b) Employ pregnant workers in easy and suitable work or service according to their physical condition without reduction in wages and benefits or
(c) To give priority to workers with physical disabilities in work responsibilities suitable to their physical condition.
