(1) If there is a provision for settlement of disputes by arbitration in an agreement, then if the procedure is mentioned in such agreement or the dispute related to the subject in the agreement itself, it shall be resolved by arbitration in accordance with this Act.
(2) Notwithstanding anything written in sub-section (1), if any civil matter of a commercial nature that can be settled in accordance with the prevailing law filed in the court, if the related parties submit an application to be resolved through mediation, such dispute shall also be resolved through mediation.
