Section 29
Dispute decision by arbitrator
: (1) If there is any dispute between the board of directors, managing director, any of the officers or employees of the institute, the decision of the dispute will be made only by one judge of the high court appointed by the government of Nepal.
(2) The arbitrator shall have the same authority as a court to make the parties to appear and produce documents regarding the dispute referred to the arbitrator for decision under sub-section (1).
(3) The decision of the arbitrator shall be final and binding on all parties. But if there is an application from the aggrieved party, the High Court can cancel the decision and give another decision only in the following cases.
(a) if it is clear that the arbitrator has acted improperly or made an arbitrary decision in a way that appears to be particularly bad or arbitrarily; or (b) If the arbitrator's decision is contrary to law.
(2) The arbitrator shall have the same authority as a court to make the parties to appear and produce documents regarding the dispute referred to the arbitrator for decision under sub-section (1).
