Section 19
Scrutiny of Nomination Papers
(1) When examining the nomination papers registered in accordance with Section 17, the candidate, his representative, proposer or one of his supporters must be present on the date, time and place specified in the notification of the election program.
(2) The election officer shall check the nomination papers of all the candidates in the presence of the persons mentioned in sub-section (1). However, even if a candidate, his representative, proposer or supporter who is required to be present is not present, this sub-section shall not be considered as an obstacle to examine the nomination paper and make a decision on the matter in accordance with the law.
(3) When the Election Officer examines the nomination paper of the candidate according to sub-section (2), if there is a complaint against any candidate according to section 18, he shall also make a decision in that regard.
(4) In the following cases, the Election Officer may suspend the action related to the scrutiny of the nomination papers to be carried out in accordance with this section and thus inform the Commission that the action related to the scrutiny of the nomination papers has been postponed:-
(a) If during the examination of nomination papers, riots and other unusual circumstances occur at that place,
(b) In case of uncontrollable circumstances due to natural calamities.
(5) If the action related to examination of the nomination papers is postponed according to sub-section (4), the election officer shall examine the nomination papers as soon as possible based on the instructions given by the Commission.
(6) Other provisions related to examination of nomination papers shall be as prescribed.
