Rule 10
Attorney General's Work, Duties and Powers
In addition to the work, duties and powers mentioned in Article 125 of the Interim Constitution of Nepal, 2063, the work, duties and powers of the Attorney General shall be as follows:-
(a) ……………..
(b) Appearing and arguing on behalf of the Government of Nepal or employees of the Government of Nepal in cases involving the Government of Nepal or involving any complex legal question or of public importance in the Supreme Court.
(c) To appear in the Supreme Court and plead for arguments in cases involving the interpretation of the Constitution or any other complex legal question or a question of public importance.
(d) To bring the attention of the concerned ministry, secretariat, department or office to the effective implementation of the court's orders or judgments.
(e) If there is any difficulty during the implementation of existing laws or if there is an urgent need to enact a law on a matter or to amend existing laws or to implement existing laws, to disclose the reasons and recommend to the Government of Nepal.
(f) If the investigation process of the case in which the Government of Nepal is the plaintiff is insufficient, or if a specific method or method should be adopted in the investigation, or if it is deemed appropriate to give other instructions in relation to the investigation, give necessary instructions to the departmental head of the investigating officer.
(g) To give necessary coordination and direction to such bodies, ministries, secretariats, departments or offices to bring standardization in legal drafts including written answers presented to the court by constitutional bodies, ministries, secretariats, departments or other government offices.
(G1) Monitoring the human rights situation of prisoners in prisons and giving necessary instructions to the relevant agencies.
(h) In any case of serious or public importance or of concern to the Government of Nepal, if the Attorney General deems it necessary to appoint other public prosecutors in addition to the designated public prosecutors to prosecute and defend the case, the Attorney General may appoint any public prosecutors to do so.
(i) any judicial or quasi-judicial bodyIf the decision or order has an impact on the rights or public interest of the Government of Nepal and there is no official designated by the law to file a case against such decision or order, to file an appeal, or to file a review application, the Attorney General himself or the government attorney appointed by him shall take legal action against such decision or order in accordance with the law.
